MakeBrandUp offers “Services” as listed on our website http://www.makebrandup.com/ under the following Terms and Conditions. Please remember that the delivery time begins after payment is received on order, not on the date the “Service” is ordered.
3. Policy on Requesting Revision or a Complete Redesign
When someone requests a re-design, a client needs to provide a precise evaluation of the initial concepts delivered to complete the next set of designs. MakeBrandUp reserves the right to decline a request for multiple re-designs if the client fails to provide sufficient information on proceeding with the next set. In terms of revisions, MakeBrandUp will revise as needed and requested by the client, as long the requests are reasonable.
4. Cancellation and Refund
Can cancel orders at any time before the initial concepts are delivered. Please provide us with clear written instructions via email if you wish to cancel your order. The subject line of the email should read “ORDER CANCELLATION.” If the order is cancelled before the initial concepts are delivered, there may still be charges depending on the scope of work completed to date. If applicable, we will refund any overpayments you have already made to the card you made payment of. Because our work is tailored to your specifications, refunds are only granted in exceptional circumstances with Executive Management’s written approval. We will not be able to cancel your order if you cannot provide us with proof of purchase or if we believe you have used the Service (s).
5. Events Outside Our Control
We will not be liable or responsible for any failure or delay in performing any of our contractual obligations caused by events beyond our reasonable control (“Force Majeure Event”). A Force Majeure Event is defined as any act, event, non-happening, omission, or accident that is beyond our reasonable control and includes, without limitation, the following: (a) Strikes, lockouts, or other forms of industrial action, (b) Civil unrest, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or undeclared), or threat or preparation for war (c) A fire, explosion, storm, landslide, earthquake, subsidence, epidemic, or other natural disasters. (d) The inability to use railways, shipping, aircraft, motor vehicles, or other public or private modes of transportation. (e) The inability to access public or private telecommunications networks. (f) Any government’s acts, decrees, legislation, regulations, or restrictions. Our performance under any Contract is deemed suspended for the Force Majeure Event, and we will have an extension of time for performance for that duration. We will use reasonable efforts to bring the Force Majeure Event to a close or to find a solution that allows us to perform our contractual obligations despite the Force Majeure Event.
The materials on the MakeBrandUp website are offered “as is.” MakeBrandUp makes no express or implied warranties and expressly disclaims and negates all other warranties, including, but not limited to, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other rights. Furthermore, MakeBrandUp makes no warranties or representations about the accuracy, likely results, or reliability of the materials on its Internet website or otherwise relating to such materials or any sites linked to this Site.
In no event shall MakeBrandUp or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit or business interruption) arising from the use or inability to use the materials on the MakeBrandUp Internet site.
